These procedures provide guidance for all complaints filed under Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, and the Americans with Disabilities Act of 1990 (ADA) as they relate to any program or activity that is administered by the City of Yuma, including consultants, contractors, and vendors. Intimidation or retaliation as a result of a complaint is prohibited by law. In addition to these procedures, complainants have the right to file a formal complaint with other State or Federal agencies or to seek private counsel for complaints alleging discrimination. Every effort will be made to resolve complaints at the lowest possible level.

Title VI Complaint Process – City of Yuma

1. Filing Deadline
   Complaints must be filed within 180 days of the alleged discrimination. Include the date the incident occurred or when it became known.
   
   
2. Who Can File
   Anyone who believes they’ve been discriminated against in a Federal Highway Administration (FHWA)-related program or activity based on race, color, or national origin can file a complaint. Use the City of Yuma Title VI Complaint Form and submit it to:

3. Investigation Outcome
   After review, the investigator will issue either:
   1. A Closure Letter (no violation found), or
   2. A Letter of Finding (LOF) (summarizes findings and any actions to be taken, such as training or discipline).
      
      
4. Reporting to ADOT
   A copy of the Closure Letter or LOF must be sent to ADOT within 72 hours. This can be done by mail or email.
   
   
5. Appeal Option
   If dissatisfied with the City’s decision, the complainant may file with the Arizona Department of Transportation (ADOT) or the Federal Highway Administration (FHWA).

LEP is a term that defines any individual not proficient in the use of the English language. The establishment and operation of an LEP program must meet the objectives set forth in Title VI of the Civil Rights Act and Executive Order 13116, Improving Access to Services for Persons with Limited English Proficiency (LEP). This Executive Order requires federal agencies receiving financial assistance to address the needs of non-English speaking persons. The Executive Order also establishes compliance standards to ensure that the programs and activities that are provided by a transportation provider in English are accessible to LEP communities. This includes providing meaningful access to individuals who are limited in their use of English. The following LEP language implementation plan, developed by the City of Yuma, is based on FHWA guidelines. 

As required, the city developed a written LEP Plan. Using 2022 American Community Survey (ACS) Census data, the city has evaluated data to determine the extent of need for translation services of its vital documents and materials. 

LEP people are a significant part of the City of Yuma’s community and marketplace.  Providing translated and interpreted information ensures LEPs can participate in and utilize the City’s services and be an active part of the community.

To decide how to provide language help for people with limited English skills, the City of Yuma uses four key factors:

1. How Many People Need Help
   Look at how many people in the community have limited English skills and would use City services if language help was available.
2. How Often They Need Help
   Consider how often these individuals interact with City programs or services.
3. How Important the Service Is
   Evaluate how critical the service is to people’s lives—like safety, health, or access to essential information.
4. What Resources Are Available
   Review the City’s budget, staff, and tools to see what kind of language support can realistically be provided.

Filing a LEP Compliant

Residents and other users of city programs and services who believe they have been denied access to a city program, service or activity because of limited English proficiency may submit a written compliant to the Language Access Coordinator within 180 days of the incident from which the complaint arises.  The procedures and timeframes applicable to Title VI Complaints will apply to complaints related to language accessibility.
